Depositions
“The term ‘deposition’ is sometimes used in a broad sense to describe any written statement verified by oath; but in its more technical and appropriate sense, the meaning of the word is limited to the written testimony of a witness given in the course of a judicial proceeding, either at law or in equity, in advance of the trial or hearing upon oral examination or in response to written interrogatories and where an opportunity is given for cross-examination.” 23 Am.Jur.2d Depositions and Discovery § 108.”’ NPM Pg. 5
Depositions are commonly notarized for divorce proceedings and other legal matters where questions (interrogatories) are being asked and the party has to respond to those questions. Those responses must be given under oath and are the depositions, or sworn statement, of the party providing them.
