Disposition of Notarial Journal and Penalties
Upon the resignation, forfeit, or revocation of a notary commission the notary public must notify the Attorney General within ninety (90) days of the location of the notary journal. The notary is still required to store the journals for a period of ten (10) years from the date of the last notarial act entered into the journal. In the event of the notary’s death the notarial journal must be deposited with the Attorney General’s office or a repository approved by the Attorney General within ninety (90) days. If the notary or notary’s representative fails to follow these requirements they will receive a fine between $50 and $500, in the discretion of the court.
