Fees Charged By Notaries

All notaries, except as limited in HRS456-18, may charge the following fees:

  • For noting the protest of mercantile paper…………………………………………………………….$5

  • For every notice thereof, and certified copy of protest…………………………………………..$5
  • For every deposition or official certificate……………………………………………………………….$5
  • For the administration of oath, including the certificate of the oath……………………….$5
  • For affixing the certificate of oath to every duplicate original beyond the fourth……$2.50
  • For taking any acknowledgement (for each party signing)….……………………………………$5
  • For every duplicate original beyond one (for each signer)……………………………………….$2.50
  • Administering an oath of loyalty………………………………………………………………………………No Charge
  • For any of the above notarial acts performed for remotely located individuals (RON), original certificate only………………………………….$25.00

While a notary may charge less than the listed fee, an overcharge of the listed fee shall be deemed to be a violation of law.

A notary may charge extra for unofficial services but may not include a round sum for the unofficial act and notarial acts together. In other words, you must line item the two acts separately. For example, if a notary is charging a person $2 to print a document and $5 for the notarization, the notary must list them as line items and cannot list them as one single item for $7.

Any notary that is collecting fees for services must obtain a General Income Tax license as the fees collected by the notary will be subject to the State General Excise Tax laws.

“Checks should be made out to “State Director of Finance”.

The fees collected by the Attorney General shall be deposited into the Notaries Public Special Fund established by HRS § 456-9.5, except that if that fund is terminated, the fees shall thereafter be deposited with the director of finance to the credit of the general fund.

The court fees for filing a copy of a commission and for each certificate of authentication shall be specified by the Supreme Court.”
